Article R5133-5 of the French Public Health Code

Where it appears that a reagent presents risks to public health, including as a result of non-compliance with the rules laid down in this chapter, the Director General of the Agence nationale de sécurité du médicament et des produits de santé shall notify the manufacturer, importer or distributor, informing it of his intentions and inviting it to submit its observations within a period which may not exceed one month. In the light of the response, the Director General of the Agency may, by reasoned decision, order the temporary or definitive withdrawal of the reagent from the market.

In an emergency, the Director General of the Agency may, as a precautionary measure, immediately order the withdrawal of the reagent by means of a reasoned decision. In this case, the decision taken in accordance with the procedure set out in the previous paragraph must be taken within two months.

The manufacturer, distributor or importer shall immediately recall from users, including in the case of a precautionary withdrawal, the reagents whose withdrawal has been ordered.

Lorsqu’il apparaît qu’un réactif présente des risques pour la santé publique, y compris du fait du non-respect des règles fixées par le présent chapitre, le directeur général de l’Agence nationale de sécurité du médicament et des produits de santé le signale au fabricant, importateur ou distributeur en l’informant de ses intentions et en l’invitant à présenter ses observations dans un délai qui ne peut excéder un mois. Au vu de la réponse, le directeur général de l’agence peut, par décision motivée, ordonner le retrait du marché du réactif à titre provisoire ou définitif.

En cas d’urgence, le directeur général de l’agence peut, à titre conservatoire, ordonner immédiatement le retrait du réactif par décision motivée. En ce cas, la décision prise selon la procédure prévue à l’alinéa précédent intervient dans un délai de deux mois.

Le fabricant, le distributeur ou l’importateur procède immédiatement auprès des utilisateurs, y compris dans le cas d’un retrait conservatoire, au rappel des réactifs dont le retrait a été décidé.
