Article R5139-10 of the French Public Health Code

I. – Authorisation is issued to a natural person for all or part of a strain of micro-organism or a type of toxin and for one or more of the operations mentioned in the first paragraph of Article R. 5139-1 carried out within a specific establishment.

Authorisation may not be issued to a legal entity. It is not transferable.

Authorisations are valid for a maximum of five years.

II – The application for renewal of the authorisation is sent by the holder to the Director General of the Agency under the conditions mentioned in articles R. 5139-3 to R. 5139-4 and no later than four months before its expiry date.

The period of validity of the initial authorisation is extended until the Director General of the Agency has taken his decision under the conditions mentioned in Articles R. 5139-4 to R. 5139-7.

When the authorisation is renewed, the new period of validity runs from the day following the expiry of the previous period of validity.

Article R5139-10

I. ― L’autorisation est délivrée à une personne physique pour tout ou partie d’une souche de micro-organisme ou d’un type de toxine et pour une ou plusieurs opérations mentionnées au premier alinéa de l’article R. 5139-1 réalisées au sein d’un établissement déterminé.

L’autorisation ne peut pas être délivrée à une personne morale. Elle n’est pas cessible.

La durée maximale de validité des autorisations est fixée à cinq ans.

II. ― La demande de renouvellement de l’autorisation est adressée par son titulaire au directeur général de l’agence dans les conditions mentionnées aux articles R. 5139-3 à R. 5139-4 et au plus tard quatre mois avant sa date d’expiration.

La durée de validité de l’autorisation initiale est prorogée jusqu’à ce que le directeur général de l’agence ait pris sa décision dans les conditions mentionnées aux articles R. 5139-4 à R. 5139-7.

Lorsque l’autorisation est renouvelée, la nouvelle durée de validité court à partir du jour suivant l’échéance de la durée de validité précédente.
