The Director General of the Agence nationale de sécurité du médicament et des produits de santé will notify the applicant of his decision within 90 days of the date on which the application is deemed to be complete. At the end of this period, the absence of a decision from the Director General will constitute an implicit decision to refuse authorisation.
When he considers it necessary to examine the application for authorisation, the General Manager may request, within a time limit that he shall set, by any means that enables this request to be dated, any additional information, or carry out any consultation, study or on-site verification. If the application for authorisation concerns genetically modified organisms, he shall obtain the opinion of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, under the conditions laid down inarticle R. 533-8 of the Environment Code, or of the Comité d’expertise des utilisations confinées d’organismes génétiquement modifiés, under the conditions laid down in articles R. 532-6 and R. 532-8 of the Environment Code. The period provided for in the first paragraph is then suspended until receipt of this information or completion of these consultations, studies or site inspections.
