Article R5139-8 of the French Public Health Code

I. – In addition to the cases mentioned in article R. 5139-3-1, authorisation is also refused if the operation or operations envisaged in the application present or are likely to present a risk to public health.

II – Authorisation is suspended or withdrawn by the Director General of the Agency in the following cases:

1° When the use of the micro-organisms and toxins or products containing them mentioned in this authorisation no longer complies with the provisions of this chapter or the conditions notified to the applicant for authorisation;

2° When it appears that the operations involving the micro-organisms and toxins mentioned in this authorisation are likely to present a risk to public health.

Article R5139-8

I. ― Outre les cas mentionnés à l’article R. 5139-3-1, l’autorisation est également refusée si la ou les opérations envisagées dans la demande présentent ou sont susceptibles de présenter un risque pour la santé publique.

II. ― L’autorisation est suspendue ou retirée par le directeur général de l’agence dans les cas suivants :

1° Lorsque l’usage des micro-organismes et toxines ou des produits en contenant mentionnés dans cette autorisation ne respecte plus les dispositions du présent chapitre ou les conditions qui ont été notifiées au demandeur de l’autorisation ;

2° Lorsqu’il apparaît que les opérations portant sur les micro-organismes et toxines mentionnés dans cette autorisation sont susceptibles de présenter un risque pour la santé publique.
