Article R5139-9 of the French Public Health Code

The decision to refuse, suspend or withdraw an authorisation must be substantiated and notified to the authorisation holder by registered letter with acknowledgement of receipt.

In the event of an implied refusal, the applicant may at any time request the reasons which led the Director General of the Agency to refuse the authorisation applied for.

Except in cases of urgency, a decision to suspend or withdraw an authorisation may only be taken after the authorisation holder has been invited to submit his observations within a time limit set by the Director General of the Agency.

Decisions to refuse, suspend or withdraw an authorisation are forwarded to the Ministers of Foreign Affairs, Defence and the Interior and to the Ministers of Agriculture, the Budget, Customs, the Environment, Research and Health.

La décision de refus, de suspension ou de retrait d’une autorisation est motivée et notifiée au titulaire de l’autorisation par lettre recommandée avec demande d’avis de réception.

En cas de décision de refus implicite, le demandeur peut demander à tout moment les motifs qui ont conduit le directeur général de l’agence à refuser l’autorisation sollicitée.

Sauf en cas d’urgence, la décision de suspension ou de retrait d’une autorisation ne peut intervenir qu’après que le titulaire de l’autorisation a été invité à présenter ses observations dans un délai déterminé par le directeur général de l’agence.

Les décisions de refus, de suspension ou de retrait d’une autorisation sont transmises aux ministres des affaires étrangères, de la défense et de l’intérieur ainsi qu’aux ministres chargés de l’agriculture, du budget, des douanes, de l’environnement, de la recherche et de la santé.
