Article R5141-1-1 of the French Public Health Code

The name of a veterinary medicinal product may be either an invented name or a common or scientific name accompanied by a trade mark or the name of the holder of the marketing authorisation or of the company operating the medicinal product. The invented name may not be confused with the common name.

Without prejudice to the application of legislation relating to trademarks or service marks, the invented name shall be chosen in such a way as to avoid confusion with other medicinal products and not to mislead as to the quality or properties of the veterinary medicinal product.

Le nom d’un médicament vétérinaire peut être soit un nom de fantaisie, soit une dénomination commune ou scientifique assortie d’une marque ou du nom du titulaire de l’autorisation de mise sur le marché ou de l’entreprise assurant l’exploitation du médicament. Le nom de fantaisie ne peut se confondre avec la dénomination commune.

Sans préjudice de l’application de la législation relative aux marques de produits ou de services, le nom de fantaisie est choisi de façon à éviter une confusion avec d’autres médicaments et à ne pas induire en erreur sur la qualité ou les propriétés du médicament vétérinaire.
