Veterinarians alone are authorised to administer, in the case provided for in a of 3° of article L. 5143-4, to animals whose flesh or products are not intended for human consumption, medicinal products for human use classified in one of the categories subject to restricted prescription by article R. 5121-77, benefiting from a marketing authorisation, necessary to avoid unacceptable suffering for these animals or to respond to specific health situations.
A list of these medicinal products is drawn up, on a proposal from the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail (French National Agency for Food, Environmental and Occupational Health Safety) after receiving the opinion of the Director General of the Agence nationale de sécurité du médicament et des produits de santé (French National Agency for the Safety of Medicines and Health Products), by order of the Ministers of Agriculture and Health. This list may, for reasons of safety or public health, restrict the use of all or some of the medicinal products it mentions to veterinarians practising in certain categories of professional domicile authorised by article R. 242-54 of the Rural and Maritime Fishing Code.
A medicinal product for human use mentioned in the first paragraph is withdrawn from the list established by order:
1° When there are difficulties in supplying the said medicinal products in human medicine ;
2° When a marketing authorisation or a temporary authorisation for use is granted to a veterinary medicinal product corresponding to the needs.
