Article R5141-23 of the French Public Health Code

I. – For the application of 1° of article R. 5141-18 , when reference is made to published scientific literature, the experts shall justify the use of this bibliographical documentation and demonstrate that it meets the requirements of the protocols adopted pursuant to article R. 5141-2 , taking into account in particular the pharmaceutical form and the constituents of the excipient.

II. – For the application of 5° of article R. 5141-20, when reference is made to published literature recognised in the tradition of veterinary homeopathic medicine practised in France, the experts justify, on the basis of the documentation provided:

-the homeopathic nature of the strains used and their traditional use in the claimed indication;

-the safety of the homeopathic veterinary medicinal product, particularly with regard to the degree of dilution of each of the constituents.

III. – For the application of 10° of article R. 5141-20, when reference is made to published literature recognised in the tradition of phytotherapeutic veterinary medicine practised in France, the experts justify on the basis of the documentation provided:

– the plant origin of the substances used and their traditional use in the claimed indication;

– the safety of the medicinal product based on substances of plant origin.

Article R5141-23

I. – Pour l’application du 1° de l’article R. 5141-18 lorsqu’il est fait référence à la littérature scientifique publiée, les experts justifient le recours à cette documentation bibliographique et démontrent qu’elle satisfait aux exigences des protocoles arrêtés en application de l’article R. 5141-2 compte tenu notamment de la forme pharmaceutique et des constituants de l’excipient.

II. – Pour l’application du 5° de l’article R. 5141-20, lorsqu’il est fait référence à la littérature publiée et reconnue dans la tradition de la médecine homéopathique vétérinaire pratiquée en France, les experts justifient, sur la base de la documentation fournie :

-le caractère homéopathique des souches utilisées et leur utilisation traditionnelle dans l’indication revendiquée ;

-l’innocuité du médicament homéopathique vétérinaire, notamment au regard du degré de dilution de chacun des constituants.

III. – Pour l’application du 10° de l’article R. 5141-20, lorsqu’il est fait référence à la littérature publiée et reconnue dans la tradition de la médecine phytothérapeutique vétérinaire pratiquée en France, les experts justifient sur la base de la documentation fournie :

– l’origine végétale des substances utilisées et leur utilisation traditionnelle dans l’indication revendiquée ;

– l’innocuité du médicament à base de substances d’origine végétale.
