Article R5141-47 of the French Public Health Code

Decisions to grant, automatically vary, refuse, renew or revoke marketing authorisations subject to the national procedure are taken in accordance with the procedures laid down in Article R. 5141-27 relating to the examination of these applications.

They may only be the subject of a contentious appeal after an informal appeal has been lodged with the Director General of the Agency.

Decisions to grant, automatically vary, suspend or revoke a marketing authorisation are published in an extract on the website of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, together with the summary of the characteristics of the corresponding product and the summary report of the assessment carried out, as referred to in Article R. 5141-28, including the reasons justifying the decision, excluding any information of an industrial or commercial confidential nature.

Les décisions d’octroi, de modification d’office, de refus, de renouvellement et de suppression d’autorisation de mise sur le marché soumises à la procédure nationale sont prises selon les modalités fixées à l’article R. 5141-27 relatives à l’instruction de ces demandes.

Elles ne peuvent faire l’objet d’un recours contentieux qu’après l’exercice d’un recours gracieux auprès du directeur général de l’agence.

Les décisions d’octroi, de modification d’office, de suspension et de suppression d’autorisation de mise sur le marché sont rendues publiques par extrait sur le site internet de l’Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, accompagnées du résumé des caractéristiques du produit correspondant et du rapport de synthèse de l’évaluation effectuée, mentionné à l’article R. 5141-28, comprenant les motifs justifiant la décision, à l’exclusion de toute information présentant un caractère de confidentialité industrielle ou commerciale.
