Article R5141-87 of the French Public Health Code

The companies referred to in article R. 5142-1 are prohibited from directly or indirectly providing users and persons authorised to prescribe or dispense medicinal products with premiums, objects or products of any kind or from granting direct or indirect material advantages other than the price conditions in force.

However, donations intended to encourage research and teaching for the benefit of public establishments or foundations recognised as being in the public interest are authorised, subject to prior declaration to the prefect of the département in which these institutions have their registered office.

Article R5141-87

Il est interdit aux entreprises mentionnées à l’article R. 5142-1 de remettre directement ou indirectement aux utilisateurs et aux personnes habilitées à prescrire ou à délivrer des médicaments des primes, des objets ou produits quelconques ou de consentir des avantages matériels directs ou indirects autres que les conditions tarifaires en vigueur.

Toutefois, sont autorisés les dons destinés à encourager la recherche et l’enseignement au profit d’établissements publics ou de fondations reconnues d’utilité publique, sous réserve de déclaration préalable au préfet du département dans lequel ces institutions ont leur siège.
