I.-The marketing authorisation holders and the companies mentioned in article R. 5142-1 may only issue free samples of veterinary medicinal products to veterinarians who make a prior written request.
II – Free samples may be issued for two years following the first effective marketing in France for :
1° A proprietary medicinal product benefiting from a first registration or a first marketing authorisation, or ;
2° A medicinal product which has already been registered or authorised and which has obtained a registration or a marketing authorisation for a new strength or a new pharmaceutical form, if the registration or authorisation includes an extension of indication.
III – The provision of free samples must also comply with the following conditions:
1° For each medicinal product, only a limited number of samples may be supplied per year and per recipient, determined according to the nature of the medicinal product and the need for the prescriber to become familiar with it; each sample is identical to the smallest pack on the market;
2° Each pharmaceutical establishment providing samples organises the control of this provision and the monitoring of the samples.
Samples may not be given directly to the public, including the owners or professional keepers of animals of species whose flesh or products are intended for human consumption, for promotional purposes, nor may they be given in areas accessible to the public at veterinary or pharmaceutical congresses.
IV – Samples must be identical to the pharmaceutical specialities concerned and must bear the words “free sample”.
These samples may not contain antibiotics or substances classified as psychotropic or narcotic, or to which the narcotic regulations apply in whole or in part.
