Article R5142-31 of the French Public Health Code

The pharmacist or veterinary surgeon in charge of a company mentioned in 1°, 2°, 3°, 4°, 5°, 6°, 7°, 8°, 9° and 10° of article R. 5142-1 or the pharmacist or veterinary surgeon delegated by his establishment carries out his duties on a permanent and continuous basis. These duties are incompatible, in particular, with the running of a pharmacy, the management of a mutual pharmacy, a pharmacy of a mining relief society, an internal use pharmacy, with the practice of veterinary medicine and with the duties of the pharmacists and veterinary surgeons mentioned in article L. 5143-8.

The duties of pharmacist in charge or delegate of a company or establishment mentioned in 1°, 2°, 3°, 4°, 5°, 6°, 7°, 8°, 9° and 10° of article R. 5142-1 are incompatible with the duties of pharmacist in charge or delegate of a company or establishment mentioned in article R. 5124-2 except for two establishments of the same company located on the same site.

Pharmacists or veterinary surgeons who replace a pharmacist or veterinary surgeon in charge or delegate must devote themselves exclusively to this activity during the period for which they are in charge.

Le pharmacien ou le vétérinaire responsable d’une entreprise mentionnée aux 1°, 2°, 3°, 4°, 5°, 6°, 7°, 8°, 9° et 10° de l’article R. 5142-1 ou le pharmacien ou le vétérinaire délégué de son établissement exerce ses fonctions de façon permanente et continue. Ces fonctions sont incompatibles, notamment avec l’exploitation d’une officine de pharmacie, la gérance d’une pharmacie mutualiste, d’une pharmacie de société de secours minière, d’une pharmacie à usage intérieur, avec l’exercice de la médecine vétérinaire et avec les fonctions des pharmaciens et des vétérinaires mentionnés à l’article L. 5143-8.

Les fonctions de pharmacien responsable ou délégué d’une entreprise ou d’un établissement mentionné aux 1°, 2°, 3°, 4°, 5°, 6°, 7°, 8°, 9° et 10° de l’article R. 5142-1 sont incompatibles avec les fonctions de pharmacien responsable ou délégué d’une entreprise ou d’un établissement mentionné à l’article R. 5124-2 sauf pour deux établissements de la même entreprise situés sur le même site.

Les pharmaciens ou vétérinaires, assurant un remplacement de pharmacien ou de vétérinaire responsable ou délégué, se consacrent exclusivement à cette activité pendant la période où ils en ont la charge.
