I.-The committee referred to in 8° of article L. 518-4 comprises a member of the Conseil d’Etat, appointed by its Vice-President, a member of the Cour des Comptes, appointed by its First President, a person appointed by the Governor of the Banque de France and three persons appointed by the Minister for the Economy. The Minister appoints the Chairman of the Committee from among the members of the Conseil d’Etat or the Cour des Comptes.
II – Each proposed appointment is referred to the Committee by the Minister for the Economy, with the exception of proposed reappointments of members on whose appointment the Committee has already given its opinion. It examines the candidate or candidates selected by the Minister. It may decide to interview the candidate(s).
The committee’s deliberations are confidential. Its opinion is adopted by majority vote. In the event of a tie, the Chairman has the casting vote.
The committee communicates its opinion to the Minister within two weeks of the referral. If it fails to do so, its opinion is deemed to be favourable.
III – The Committee’s opinions are published in the Journal officiel de la République française.
IV -The members of the Committee carry out their duties free of charge. However, their travel and subsistence expenses may be reimbursed under the conditions laid down in the regulations applicable to State civil servants.
