Article R519-37 of the French Monetary and Financial Code

The association shall ensure that its members comply with the obligation to take out the professional indemnity insurance referred to in Article L. 519-3-4.

In particular, it verifies that this contract, where required, covers the activities carried out by their members as intermediaries in banking and payment services and that it meets the conditions set out in I and II of article R. 519-16.

To this end, each member shall provide the association each year with a declaration indicating the nature of its activities, the scope and amount of cover and the excesses provided for in the insurance contract taken out or the existence of a mandate exempting it from this insurance. The Association must be notified of any change affecting the validity of this insurance or mandate. The member shall keep the supporting documents for this declaration at the Association’s disposal.

L’association vérifie que ses membres respectent l’obligation de souscription d’un contrat d’assurance de responsabilité civile professionnelle mentionnée à l’article L. 519-3-4.


Elle vérifie notamment que ce contrat, lorsqu’il est exigé, couvre les activités que leurs membres exercent en qualité d’intermédiaire en opérations de banque et en services de paiement et qu’il remplit les conditions mentionnées aux I et II de l’article R. 519-16.


A cette fin, tout membre fournit chaque année à l’association une déclaration indiquant la nature de ses activités, le champ d’application et le montant des garanties ainsi que les franchises prévues par le contrat d’assurance souscrit ou l’existence d’un mandat le dispensant de cette assurance. Toute modification affectant la validité de cette assurance ou de ce mandat doit être communiquée à l’association. Le membre tient les éléments justificatifs de cette déclaration à la disposition de l’association.
