Article R5211-1-2 of the French General Code of Local Authorities

When it is necessary to proceed with a new distribution of seats on the deliberative body of a public establishment for intercommunal cooperation with its own tax status in the cases provided for in article L. 5211-6-2, this distribution takes place within three months of:

1° The date of entry into force of the order of the representative of the State in the department pronouncing the creation, merger or extension of the perimeter of a public inter-communal cooperation establishment with its own tax status;

2° The date of entry into force of the order of the representative of the State in the department pronouncing the creation of a new commune ;

This distribution is recorded by order of the State representative in the department when the communes are part of the same department or by joint order of the State representatives in the departments concerned in the opposite case.

Article R5211-1-2

Lorsqu’il y a lieu de procéder à une nouvelle répartition des sièges de l’organe délibérant d’un établissement public de coopération intercommunale à fiscalité propre dans les cas prévus à l’article L. 5211-6-2, cette répartition intervient dans un délai de trois mois à compter de :

1° La date d’entrée en vigueur de l’arrêté du représentant de l’Etat dans le département prononçant la création, la fusion ou l’extension de périmètre d’un établissement public de coopération intercommunale à fiscalité propre ;

2° La date d’entrée en vigueur de l’arrêté du représentant de l’Etat dans le département prononçant la création d’une commune nouvelle ;

Cette répartition est constatée par arrêté du représentant de l’Etat dans le département lorsque les communes font partie du même département ou par arrêté conjoint des représentants de l’Etat dans les départements concernés dans le cas contraire.
