Article R5211-1 of the French General Code of Local Authorities

Where different rules govern the administrative control of communes according to the size of their population, the population of all the communes forming the public establishment of inter-communal cooperation is taken into account to determine the rules that should be applied.

In cases where the public establishment for inter-municipal cooperation extends over several départements, the administrative control referred to in article L. 5211-4 is exercised by the prefect of the department to which the commune with the headquarters of the public establishment of inter-communal cooperation belongs.

Lorsque des règles différentes régissent le contrôle administratif des communes suivant l’importance de leur population, la population de l’ensemble des communes formant l’établissement public de coopération intercommunale entre en ligne de compte pour déterminer les règles qu’il y a lieu d’appliquer.

Dans le cas où l’établissement public de coopération intercommunale s’étend sur plusieurs départements, le contrôle administratif visé à l’article L. 5211-4 est exercé par le préfet du département auquel appartient la commune siège de l’établissement public de coopération intercommunale.
