The application is deemed complete if, within fifteen days of receipt, the association mentioned inarticle L. 5214-1 of the Labour Code has not notified the employer of the list of missing documents or information.
On receipt of these documents or information, the body will notify the applicant, by any means that provides proof of the date of receipt, that the application is complete. If the missing documents and information are not received within one month, the application is deemed to have lapsed.
The association referred to in Article L. 5214-1 has two months from the date of receipt of the complete application to decide on the application and notify the employer of its response by any means that provides proof of receipt.
If the association mentioned in Article L. 5214-1 changes its position, it will inform the establishment in the same way.
In the absence of a response to its request by the date provided for in 2° of Article R. 5212-1, the employer is required to send the annual declaration referred to in Article L. 5212-5 to the association referred to in Article L. 5214-1 by this date at the latest.
In the event of a response after the date provided for in 2° of article R. 5212-1, the employer shall, if necessary, send a corrective declaration incorporating the elements of the response provided, to the aforementioned association.
