Article R5212-35-3 of the French Public Health Code

The certificate drawn up by the person responsible for the transfer of the second-hand medical device certifies that it has undergone regular maintenance in accordance with the provisions of article R. 5212-28 and, where the device is subject to internal or external quality control in application of article R. 5212-27, that its characteristics and performance comply with the acceptability criteria mentioned in 1° of this article. It mentions the information required to identify the medical device, the date on which it was first put into service or, if the device has never been put into service, the date on which it was first acquired.

L’attestation établie par la personne responsable de la cession du dispositif médical d’occasion certifie qu’il a bénéficié d’une maintenance régulière conforme aux dispositions de l’article R. 5212-28 et, lorsque le dispositif est soumis au contrôle de qualité interne ou externe en application de l’article R. 5212-27, que ses caractéristiques et performances sont conformes aux critères d’acceptabilité mentionnés au 1° de cet article. Elle mentionne les indications nécessaires pour identifier le dispositif médical, la date de première mise en service ou, dans le cas où le dispositif n’a jamais été mis en service, la date de première acquisition.
