Article R5212-35-5 of the French Public Health Code

By way of derogation from the provisions of article R. 5212-35-4, where the second-hand medical device being transferred has never been put into service, the file is composed solely of the following elements:

1° The report of receipt of the medical device by the person responsible for the transfer, except where the transfer takes place before receipt of the device concerned;

2° A declaration on their honour by the person responsible for the transfer of the second-hand medical device, in which they certify that the device has never been put into service.

Par dérogation aux dispositions de l’article R. 5212-35-4, lorsque le dispositif médical d’occasion faisant l’objet de la cession n’a jamais été mis en service, le dossier est composé des seuls éléments suivants :

1° Le procès-verbal de réception du dispositif médical par la personne responsable de la cession, sauf lorsque la cession a lieu avant la réception du dispositif concerné ;

2° Une déclaration sur l’honneur de la personne responsable de la cession du dispositif médical d’occasion, dans laquelle elle certifie que le dispositif n’a jamais été mis en service.
