Article R5215-12 of the French General Code of Local Authorities

Work in progress on the date of the transfer of powers is continued:

1° For the operations listed in article R. 5215-4, under the direction, responsibility and at the expense of the communes;

2° For the operations listed in article R. 5215-5, under the direction, responsibility and charge of the urban community.

Any amicable agreements reached between the communes and the community set the date from which the transfer of charges and responsibilities takes place.

Les travaux en cours à la date du transfert des compétences sont poursuivis :

1° Pour les opérations énumérées à l’article R. 5215-4, sous la direction, la responsabilité et à la charge des communes ;

2° Pour les opérations énumérées à l’article R. 5215-5, sous la direction, la responsabilité et à la charge de la communauté urbaine.

Les accords amiables éventuellement intervenus entre les communes et la communauté fixent la date à partir de laquelle s’opère le transfert des charges et des responsabilités.
