Article R5215-6 of the French General Code of Local Authorities

Within sixty days of the date of the transfer of powers, the municipal council of each municipality draws up lists of the operations mentioned in article R. 5215-5, distinguishing between:

1° Operations decided upon that have not received a start on execution;

2° Operations in progress;

3° Operations in progress that the communes nevertheless wish to see transferred to the community;

4° Operations that have not received a start on execution, that the commune nevertheless wishes to carry out.

For each operation, the related means of financing are indicated.

For operations in progress that it wishes to see continued by the community, the municipal council formulates proposals on the conditions of the communal participation in their financing.

If, within the time limit set above, a municipal council has not deliberated on the matters mentioned in the preceding paragraphs, the prefect shall draw up a list of the operations decided upon, specifying those which have begun to be carried out.

Article R5215-6

Dans un délai de soixante jours à compter de la date du transfert des compétences, le conseil municipal de chaque commune dresse des listes des opérations mentionnées à l’article R. 5215-5, en distinguant :

1° Les opérations décidées qui n’ont pas reçu un commencement d’exécution ;

2° Les opérations en cours d’exécution ;

3° Les opérations en cours d’exécution que les communes désirent néanmoins voir transférer à la communauté ;

4° Les opérations n’ayant pas reçu de commencement d’exécution, que la commune souhaite néanmoins réaliser.

Pour chaque opération, sont indiqués les moyens de financement y afférents.

Pour les opérations en cours d’exécution qu’il souhaite voir poursuivre par la communauté, le conseil municipal formule des propositions sur les conditions de la participation communale à leur financement.

Si, dans le délai fixé ci-dessus, un conseil municipal n’a pas délibéré sur les objets mentionnés aux alinéas qui précèdent, le préfet dresse la liste des opérations décidées en précisant celles qui ont reçu un commencement d’exécution.
