Article R5221-41 of the French Labour Code

Pursuant to article L. 5221-8, employers must check that the foreign national they intend to employ is legally resident. To this end, the employer shall refer the matter to the prefect of the département in which the employing establishment has its registered office or the individual employer resides.

The procedures for implementing this article, in particular the information that may be requested from the prefect and the procedures for referring matters to him, are set by order of the minister responsible for immigration.

Article R5221-41

En application de l’article L. 5221-8, l’employeur vérifie que l’étranger qu’il se propose d’embaucher est en situation régulière au regard du séjour. A cette fin, l’employeur saisit le préfet du département dans lequel l’établissement employeur a son siège ou le particulier employeur sa résidence.

Les modalités de mise en œuvre du présent article, notamment les informations qui peuvent être demandées au préfet et les modalités de sa saisine, sont fixées par arrêté du ministre en charge de l’immigration.
