Article R53-15 of the French Code of Criminal Procedure

I.-The right to object does not apply to this processing pursuant to Article 23 of Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and Articles 56 and 110 de la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés.

II.The rights of information and access referred to in Articles 13 to 15 of the aforementioned Regulation (EU) 2016/679 of 27 April 2016 and in Articles 104 and 105 of the aforementioned Act of 6 January 1978 may be exercised by contacting the Head of the National Forensic Science Service of the Ministry of the Interior.

III.The rights of rectification and limitation of data referred to in Articles 16 to 18 of the aforementioned Regulation (EU) 2016/679 of 27 April 2016 and in the Article 106 of the aforementioned Act of 6 January 1978 may be exercised by contacting the public prosecutor of the court within whose jurisdiction the proceedings were conducted and gave rise to the recording.

Article R53-15

I.-Le droit d’opposition ne s’applique pas au présent traitement en application de l’article 23 du règlement (UE) 2016/679 du 27 avril 2016 relatif à la protection des personnes physiques à l’égard du traitement des données à caractère personnel et à la libre circulation de ces données, et abrogeant la directive 95/46/ CE et des articles 56 et 110 de la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés.

II.-Les droits d’information et d’accès mentionnés aux articles 13 à 15 du règlement (UE) 2016/679 du 27 avril 2016 précité et aux articles 104 et 105 de la loi du 6 janvier 1978 précitée s’exercent auprès du chef du service national de police scientifique du ministère de l’intérieur.

III.-Les droits de rectification et à la limitation des données mentionnés aux articles 16 à 18 du règlement (UE) 2016/679 du 27 avril 2016 précité et à l’article 106 de la loi du 6 janvier 1978 précitée s’exercent auprès du procureur de la République de la juridiction dans le ressort de laquelle la procédure a été menée et a donné lieu à l’enregistrement.
