Article R53-21 of the French Code of Criminal Procedure

The magistrate mentioned in article R. 53-16, assisted by the committee provided for in the same article, controls the conditions under which the central service for the preservation of biological samples operates. It may carry out any on-site checks.

The authority responsible for the service shall send it an annual activity report and, at its request, any information relating to the operation of the service.

The magistrate shall draw up an annual report and send it to the Minister of Justice: he or she shall also send a copy to the Minister of the Interior and to the Commission nationale de l’informatique et des libertés.

Le magistrat mentionné à l’article R. 53-16, assisté par le comité prévu au même article, contrôle les conditions dans lesquelles fonctionne le service central de préservation des prélèvements biologiques. Il peut procéder à toute vérification sur place.

L’autorité responsable du service lui adresse un rapport annuel d’activité ainsi que, sur sa demande, toutes informations relatives au fonctionnement du service.

Le magistrat établit un rapport annuel qu’il adresse au ministre de la justice : il en adresse aussi une copie au ministre de l’intérieur et à la Commission nationale de l’informatique et des libertés.
