Article R53-55 of the French Code of Criminal Procedure

By way of derogation from Article R. 521-20, the deletion of the registration shall be requested by the Agency for the Management and Recovery of Seized and Confiscated Assets, which shall produce in support of its request a copy of the final decision to release, dismiss, discharge, acquit or confiscate.

On receipt of this request, the court clerk will proceed to cancel the entry, mentioning the formality and its date in the margin of the entry, without indicating the nature of the decision that led to the cancellation.

Par dérogation à l’article R. 521-20, la radiation de l’inscription est sollicitée par l’Agence de gestion et de recouvrement des avoirs saisis et confisqués, qui produit à l’appui de sa demande la copie de la décision définitive de mainlevée, de non-lieu, de relaxe, d’acquittement ou de confiscation.


A réception de cette demande, le greffier procède à la radiation de l’inscription en mentionnant la formalité et sa date en marge de l’inscription, sans indiquer la nature de la décision ayant conduit à la radiation.
