Article R53-8-50 of the French Code of Criminal Procedure

If the security surveillance takes place at the end of a security detention period, the sentence enforcement judge with territorial jurisdiction to supervise the person is notified before the person leaves the socio-medico-judicial security centre, to enable the person concerned to be taken into care immediately.

If the person is subject to a care order, the coordinating doctor and their attending doctor are appointed before they are discharged, in accordance with the provisions of the articles R. 3711-8 and R. 3711-17 of the Public Health Code.

If the person is placed under mobile electronic surveillance, the device provided for by Article R. 61-22 is fitted before they are released. If the person refuses to have this device fitted, the president of the regional court for secure detention is immediately informed, in order to apply, where applicable, the provisions of the last paragraph of Article 706-53-19.

Si la surveillance de sûreté intervient à l’issue d’une rétention de sûreté, le juge de l’application des peines territorialement compétent pour contrôler la personne en est avisé avant sa sortie du centre socio-médico-judiciaire de sûreté, afin de permettre une prise en charge immédiate de l’intéressé.


Si la personne fait l’objet d’une injonction de soins, la désignation du médecin coordonnateur et de son médecin traitant intervient avant sa sortie, conformément aux dispositions des articles R. 3711-8 et R. 3711-17 du code de la santé publique.


Si la personne est placée sous surveillance électronique mobile, le dispositif prévu par l’article R. 61-22 est posé avant sa sortie. Si la personne refuse la pose de ce dispositif, le président de la juridiction régionale de la rétention de sûreté en est immédiatement informé, pour faire application, le cas échéant, des dispositions du dernier alinéa de l’article 706-53-19.
