Article R53-8-51 of the French Code of Criminal Procedure

At least three months before the scheduled end of the secure surveillance period, the sentence enforcement judge, or failing this, the public prosecutor, will arrange for the medical examination to be carried out and may refer the matter to the multidisciplinary commission on security measures for an opinion. The sentence enforcement judge, or failing this the public prosecutor, will refer the matter to the regional court for secure detention at least one month before the expiry of the measure, together with its reasoned opinion.

Trois mois au moins avant la fin prévue de la surveillance de sûreté, le juge de l’application des peines, ou à défaut le procureur de la République, fait procéder à l’expertise médicale et saisit éventuellement la commission pluridisciplinaire des mesures de sûreté pour avis. Le juge de l’application des peines, ou à défaut le procureur de la République, saisit la juridiction régionale de la rétention de sûreté un mois au moins avant l’expiration de la mesure, accompagné de son avis motivé.
