I.-When a reasoned request is made to this end, the Director General of the Agence nationale de sécurité du médicament et des produits de santé shall send, by any means, the report mentioned in Article R. 5313-3 to the European authorities responsible for the safety of the health products mentioned in Article L. 5311-1.
This report shall be sent under conditions guaranteeing the confidentiality of sensitive information.
The Director General of the Agency may ask the competent authority of another Member State of the European Union to send him the conclusions of a report drawn up as part of an inspection referred to in Article 111 of Directive 2001/83/EC on the Community code relating to medicinal products for human use, in order to monitor compliance with the good practices referred to in Article L. 5121-5.
When the Director General of the Agency considers that he is unable to accept the conclusions of the report mentioned in the previous paragraph, for duly substantiated public health reasons, he shall immediately inform the European Commission and the European Medicines Agency, in accordance with the provisions of article 122, paragraph 3, of the same directive.
II – In the event of a cooperation agreement between the French or European authorities and a third State and when a reasoned request is made to this end, the Director General of the Agence nationale de sécurité du médicament et des produits de santé may send, by any means, the report mentioned in Article R. 5313-3 to the authorities of the State concerned responsible for the safety of the health products mentioned in Article L. 5311-1.
This report is sent under conditions that guarantee the confidentiality of sensitive information.
The Director General of the Agency may ask the competent authority of the State concerned to send him the conclusions of a report drawn up as part of an inspection mentioned in Article 111 of Directive 2001/83/EC on the Community code relating to medicinal products for human use, in order to monitor compliance with the good practices mentioned in Article L. 5121-5.
