I. – Pursuant to the provisions ofArticle L. 532-3-1 and without prejudice to the provisions of I ofArticle L. 531-6, the Autorité de contrôle prudentiel et de résolution shall be informed in advance of any proposed changes to the financial instruments and investment services taken into account for the authorisation of an investment services provider other than an asset management company.
The Autorité de contrôle prudentiel et de résolution shall inform the Autorité des marchés financiers within five working days of receiving a complete application.
II. – The Autorité des marchés financiers notifies the applicant of its decision on the proposed amendment and informs the Autorité de contrôle prudentiel et de résolution within two months of receipt of the proposed amendment by the Autorité des marchés financiers. If the Autorité des marchés financiers does not respond within this period, the application is deemed to have been rejected.
III. – The Autorité de contrôle prudentiel et de résolution shall give its opinion on proposed changes to the authorisation of investment firms within four months of receipt of the complete application. It will rule on proposed changes to the authorisation of credit institutions to provide investment services within five months of receipt of the complete application. If the Autorité de contrôle prudentiel et de résolution does not respond within these time limits, the application is deemed to have been accepted.
IV. – The Autorité de contrôle prudentiel et de résolution, on its own initiative or at the request of the Autorité des marchés financiers, may ask the applicant for any additional information needed to examine the case. The time limit given to these authorities to decide on the proposed authorisation is then suspended until receipt of the information requested.
