Article R5322-13 of the French Public Health Code

The decisions of the Board of Directors concerning the budget and the financial account are enforceable under the conditions laid down in Title III of Decree no. 2012-1246 of 7 November 2012 on public budgetary and accounting management. Decisions relating to the matters mentioned in 2°, 9° and 10° of Article R. 5322-11 are approved under the same conditions. Decisions relating to 14° of article R. 5322-11 are enforceable one month after they have been sent to the Minister for Health, the Minister for the Budget and the Minister for the Civil Service, unless one or more of these ministers objects. Decisions relating to 15° of article R. 5322-11 are enforceable one month after they have been sent to the Minister for Health and the Minister for the Budget, unless one or more of these ministers objects. Other decisions are enforceable one month after they have been sent to the Minister for Health and the Minister for the Budget. In urgent cases, the Minister for Health may authorise immediate implementation.

Les délibérations du conseil d’administration portant sur le budget et le compte financier sont exécutoires dans les conditions prévues par le titre III du décret n° 2012-1246 du 7 novembre 2012 relatif à la gestion budgétaire et comptable publique. Les délibérations portant sur les matières mentionnées aux 2°, 9°, 10° de l’article R. 5322-11 sont approuvées dans les mêmes conditions. Les délibérations relatives au 14° de l’article R. 5322-11 sont exécutoires un mois après leur transmission au ministre chargé de la santé, au ministre chargé du budget et au ministre chargé de la fonction publique, sauf opposition de l’un ou de ces ministres. Les délibérations relatives au 15° de l’article R. 5322-11 sont exécutoires un mois après leur transmission au ministre chargé de la santé et au ministre chargé du budget, sauf opposition de l’un ou de ces ministres. Les autres délibérations sont exécutoires un mois après leur transmission au ministre chargé de la santé et au ministre chargé du budget. En cas d’urgence, le ministre chargé de la santé peut autoriser l’exécution immédiate.
