Article R5322-2 of the French Public Health Code

The term of office of the members of the Board of Directors is three years, with the exception of the term of office of the members mentioned in 2° of article R. 5322-1. For the latter, the term of office of deputies ends with the legislature for which they were elected and the term of office of senators ends with each partial renewal of the Senate. The term of office of members of the Board of Directors is renewable once.

The appointments of the members of the Board of Directors mentioned in 2°, 3°, 4°, 5° and 6° of article R. 5322-1 are the subject of an order by the Minister for Health published in the Journal officiel de la République française.

For each of the members mentioned in 1°, 3°, 4°, 5° and 7 of article R. 5322-1, an alternate member is appointed under the same conditions as the full member.

Appointments to the Board of Directors are made in accordance with the rules defined in the first two paragraphs of article L. 1411-5-2, specified in section 3 of chapter I of title I of book 4 of part one.

Article R5322-2

Le mandat des membres du conseil d’administration est de trois ans, à l’exception du mandat des membres mentionnés au 2° de l’article R. 5322-1. Pour ces derniers, le mandat des députés prend fin avec la législature au titre de laquelle ils ont été élus et le mandat des sénateurs prend fin lors de chaque renouvellement partiel du Sénat. Le mandat des membres du conseil d’administration est renouvelable une fois.

Les nominations des membres du conseil d’administration mentionnés aux 2°, 3°, 4°, 5° et 6° de l’article R. 5322-1 font l’objet d’un arrêté du ministre chargé de la santé publié au Journal officiel de la République française.

Pour chacun des membres mentionnés aux 1°, 3°, 4°, 5° et 7 de l’article R. 5322-1, un suppléant est nommé dans les mêmes conditions que le membre titulaire.

Il est procédé aux nominations au sein du conseil d’administration dans le respect des règles définies aux deux premiers alinéas de l’article L. 1411-5-2, précisées à la section 3 du chapitre Ier du titre Ier du livre 4 de la première partie.
