Article R5412-1 of the French Public Health Code

For the application of Article L. 5412-1, the inspectors referred to in Article R. 5313-1 are authorised to investigate and establish criminal offences by a decision of the Director General of the Agency, specifying the name, capacity and qualifications of the agents concerned.

The authorisation lasts for two years. It may be renewed.

Authorised agents take the following oath before the judicial court in whose jurisdiction the head office of the agency is located: “I swear and promise to perform my duties faithfully and well and to observe all the obligations imposed upon me by them. I also swear not to reveal or use anything brought to my knowledge in the performance of my duties. “

The provisions of the previous paragraph do not apply to public health inspecting pharmacists working as inspectors for the Agency when they have already taken an oath in respect of the pharmacy inspection mentioned in article L. 5127-1.

Pour l’application de l’article L. 5412-1, l’habilitation des inspecteurs mentionnés à l’article R. 5313-1 à la recherche et à la constatation d’infractions pénales est conférée par décision du directeur général de l’agence précisant les nom, qualités et qualifications des agents concernés.

L’habilitation a une durée de deux ans. Elle est renouvelable.

Les agents ainsi habilités prêtent, devant le tribunal judiciaire dans le ressort duquel se trouve le siège de l’agence, le serment suivant : ” Je jure et promets de bien et loyalement remplir mes fonctions et d’observer en tout les devoirs qu’elles m’imposent. Je jure également de ne rien révéler ou utiliser de ce qui sera porté à ma connaissance à l’occasion de l’exercice de mes fonctions. “

Les dispositions de l’alinéa précédent ne sont pas applicables aux pharmaciens inspecteurs de santé publique exerçant en qualité d’inspecteur de l’agence lorsqu’ils ont déjà prêté serment au titre de l’inspection de la pharmacie mentionnée à l’article L. 5127-1.
