Article R561-16-2 of the French Monetary and Financial Code

The persons mentioned in 1° to 1°c of Article L. 561-2, acting as acquirers within the meaning of EU Regulation 2015/751 of the European Parliament and of the Council of 29 April 2015, shall only accept a payment made by means of electronic money usable on a physical medium issued in a third country and whose holder is not identified, nor his identity verified, under the conditions provided for respectively in Articles R. 561-5 and R. 561-5-1 respectively, unless these electronic money instruments meet the requirements set out in Article R. 561-16-1 in that country.

Les personnes mentionnées aux 1° à 1° quater de l’article L. 561-2, agissant comme acquéreurs au sens du règlement UE 2015/751 du Parlement européen et du Conseil du 29 avril 2015, n’acceptent un paiement effectué au moyen de monnaie électronique utilisable sur support physique émise dans un pays tiers et dont le détenteur n’est pas identifié, ni son identité vérifiée, dans les conditions respectivement prévues aux articles R. 561-5 et R. 561-5-1, qu’à la condition que ces instruments de monnaie électronique répondent dans ce pays aux exigences prévues à l’article R. 561-16-1.
