Article R561-28 of the French Monetary and Financial Code

By way of derogation from Articles R. 561-23 and R. 561-24, the persons mentioned in 1° to 6° and 7°a of Article L. 561-2 who belong to the same group within the meaning of Article L. 561-33 may agree, in agreement with their parent undertaking or their central body, to the joint appointment of a person within the group. The person so authorised must carry out his duties in France. The group shall communicate the identity of this person to the department referred to in Article L. 561-23 and to each supervisory authority concerned.

Article R561-28

Par dérogation aux articles R. 561-23 et R. 561-24, les personnes mentionnées aux 1° à 6° et au 7° bis de l’article L. 561-2 qui appartiennent à un même groupe au sens de l’article L. 561-33 peuvent convenir, en accord avec leur entreprise-mère ou leur organe central, d’une désignation conjointe d’une personne au sein du groupe. La personne ainsi habilitée doit exercer ses fonctions en France. Le groupe communique l’identité de cette personne au service mentionné à l’article L. 561-23 et à chaque autorité de contrôle concernée.
