Article R561-38-9 of the French Monetary and Financial Code

The procedures for applying this section with regard to the nature and scope of internal procedures, the rules for organising internal control and the content of the reports on internal control provided for in Articles R. 561-38-6 and R. 561-38-7, as well as the deadline and procedures for forwarding them to the supervisory authority, are specified as necessary:

a) By an order of the Minister responsible for the economy for the persons mentioned in 1° to 8°, 10° to 11° and 15° of Article L. 561-2, with the exception of the persons mentioned in 2° of I of Article L. 561-36 ;

b) By the general regulations of the Autorité des marchés financiers for the persons mentioned in 2° of I of Article L. 561-36;

c) By an order of the Minister for the Interior for the persons mentioned in 9° of Article L. 561-2;

d) By an order of the Minister for the Budget for the persons mentioned in 9° bis of Article L. 561-2;

e) By a joint order of the ministers responsible for the economy and the budget for the persons mentioned in 12° of Article L. 561-2;

f) By an order of the Minister of Justice for the persons mentioned in 12° bis to 14° of Article L. 561-2;

g) By an order of the Minister for Sport for the persons mentioned in 16° of article L. 561-2.

Article R561-38-9

Les modalités d’application de la présente section en ce qui concerne la nature et la portée des procédures internes, les règles d’organisation du contrôle interne et le contenu des rapports sur le contrôle interne prévus aux articles R. 561-38-6 et R. 561-38-7, ainsi que le délai et les modalités de leur transmission à l’autorité de contrôle, sont précisées en tant que de besoin :

a) Par un arrêté du ministre chargé de l’économie pour les personnes mentionnées aux 1° à 8°, 10° à 11° et 15° de l’article L. 561-2, hormis pour les personnes mentionnées au 2° du I de l’article L. 561-36 ;

b) Par le règlement général de l’Autorité des marchés financiers pour les personnes mentionnées au 2° du I de l’article L. 561-36 ;

c) Par un arrêté du ministre chargé de l’intérieur pour les personnes mentionnées au 9° de l’article L. 561-2 ;

d) Par un arrêté du ministre chargé du budget pour les personnes mentionnées au 9° bis de l’article L. 561-2 ;

e) Par un arrêté conjoint des ministres chargés de l’économie et du budget pour les personnes mentionnées au 12° de l’article L. 561-2 ;

f) Par un arrêté du garde des sceaux, ministre de la justice, pour les personnes mentionnées aux 12° bis à 14° de l’article L. 561-2 ;

g) Par un arrêté du ministre chargé des sports pour les personnes mentionnées au 16° de l’article L. 561-2.
