Article R561-63 of the French Monetary and Financial Code

I. – Where the injunction has been complied with within the time limit, the case is removed from the list.

II. – If the injunction has not been complied with, the court clerk will draw up a report stating that the injunction has not been complied with.

The President of the Court decides on the measures to be taken and, if necessary, settles the penalty payment.

This decision is final where the amount of the penalty does not exceed the final jurisdiction of the Commercial Court.

The amount of the penalty payment is recovered in the same way as for non-tax debts and paid into the general State budget.

The decision is notified by the court clerk to the legal representative of the company or legal entity and, where applicable, to the applicant.

The appeal is lodged, investigated and judged in accordance with the rules applicable to proceedings without compulsory representation.

Article R561-63

I. – Lorsque l’injonction a été exécutée dans le délai imparti, l’affaire est retirée du rôle.

II. – Dans le cas contraire, le greffier constate l’inexécution de l’injonction par procès-verbal.

Le président du tribunal statue sur les mesures à prendre et, s’il y a lieu, procède à la liquidation de l’astreinte.

Il statue en dernier ressort lorsque le montant de l’astreinte n’excède pas le taux de compétence en dernier ressort du tribunal de commerce.

Le montant de l’astreinte est recouvré comme en matière de créances étrangères à l’impôt et versé au budget général de l’Etat.

La décision est notifiée par le greffier au représentant légal de la société ou de l’entité juridique et, le cas échéant, au requérant.

L’appel est formé, instruit et jugé selon les règles applicables à la procédure sans représentation obligatoire.
