Article R61-2 of the French Code of Criminal Procedure

The sentence enforcement judge may decide by reasoned order that the imprisonment provided for in the third paragraph of article 131-36-1 of the French Penal Code if it appears that the offender is able to comply with the obligations of socio-judicial supervision. Only the period of imprisonment actually served is taken into account for the application of the provisions of the last paragraph of article 763-5.

Article R61-2

Le juge de l’application des peines peut décider par ordonnance motivée qu’il soit mis fin à l’emprisonnement prévu au troisième alinéa de l’article 131-36-1 du code pénal s’il lui apparaît que le condamné est en mesure de respecter les obligations du suivi socio-judiciaire. Seule la période d’emprisonnement effectivement accomplie est prise en compte pour l’application des dispositions du dernier alinéa de l’article 763-5.
