Article R61 of the French Code of Criminal Procedure

The sentence enforcement judge referred to in article 763-1 shall summon the person sentenced to socio-judicial supervision to remind them of the obligations to which they are subject pursuant to the sentencing decision and, where applicable, notify them of the additional obligations that they have ordered pursuant to l’article 763-3. It will inform the offender of the conditions under which compliance with these obligations will be monitored. It shall remind him of the duration of the socio-judicial supervision as well as the maximum term of imprisonment incurred pursuant to article 131-36-1 of the Penal Code in the event of failure to comply with these obligations.

When the convicted person is subject to a care order pursuant to the provisions of the first paragraph of article 131-36-4 of the Penal Code or pursuant to the provisions of the third paragraph of article 763-3 of this code, the judge shall inform him of the coordinating doctor that he has appointed. The judge will inform the offender that he or she must meet this doctor within a period set by the judge, which may not exceed one month.

The sentence enforcement judge will inform the offender in the same way if there are any changes to his or her obligations.

The completion of these formalities will be recorded in a report, a copy of which will be given to the offender after signature.

Le juge de l’application des peines mentionné à l’article 763-1 convoque la personne condamnée à un suivi socio-judiciaire pour lui rappeler les obligations auxquelles elle est soumise en application de la décision de condamnation et, le cas échéant, lui notifier les obligations complémentaires qu’il a ordonnées en application de l’article 763-3. Il porte à sa connaissance les conditions dans lesquelles le respect de ces obligations sera contrôlé. Il lui rappelle la durée du suivi socio-judiciaire ainsi que la durée maximum de l’emprisonnement encouru en application de l’article 131-36-1 du code pénal en cas d’inobservation de ces obligations.

Lorsque le condamné fait l’objet d’une injonction de soins en application des dispositions du premier alinéa de l’article 131-36-4 du code pénal ou en application des dispositions du troisième alinéa de l’article 763-3 du présent code, le juge lui indique le médecin coordonnateur qu’il a désigné. Il l’avise qu’il devra rencontrer ce médecin dans un délai qu’il fixe et qui ne peut être supérieur à un mois.

Le juge de l’application des peines informe le condamné dans les mêmes formes en cas de modification de ses obligations.

L’accomplissement de ces formalités est constaté par procès-verbal dont une copie est remise à l’intéressé après émargement.
