Article R611-16 of the French Commercial code

In the event of failure to comply with the injunction to do which he has issued, the president of the court shall rule on the liquidation of the astreinte.

He shall rule as a last resort when the amount of the astreinte does not exceed the rate of jurisdiction as a last resort of the commercial court.

The amount of the penalty imposed is paid to the Treasury and recovered as in the case of non-tax debts.

The decision is communicated to the Treasury and served at the registrar’s behest on the legal representative of the legal entity or the individual limited liability entrepreneur. The appeal is lodged, investigated and judged in accordance with the rules applicable to proceedings without compulsory representation. The public prosecutor may appeal.

En cas d’inexécution de l’injonction de faire qu’il a délivrée, le président du tribunal statue sur la liquidation de l’astreinte.

Il statue en dernier ressort lorsque le montant de l’astreinte n’excède pas le taux de compétence en dernier ressort du tribunal de commerce.

Le montant de la condamnation prononcée est versé au Trésor public et recouvré comme en matière de créances étrangères à l’impôt.

La décision est communiquée au Trésor public et signifiée à la diligence du greffier au représentant légal de la personne morale ou à l’entrepreneur individuel à responsabilité limitée. L’appel est formé, instruit et jugé selon les règles applicables à la procédure sans représentation obligatoire. Les voies de recours sont ouvertes au ministère public.
