Article R611-42 of the French Commercial code

An appeal against a judgment rejecting homologation is lodged, investigated and judged in accordance with the rules specific to non-contentious proceedings. However, the parties are exempt from the requirement to be represented by a lawyer.

In all other cases, the appeal is lodged, heard and judged in accordance with the rules specific to proceedings without compulsory representation.

L’appel du jugement rejetant l’homologation est formé, instruit et jugé selon les règles propres à la procédure en matière gracieuse. Toutefois, les parties sont dispensées du ministère de l’avocat.

Dans les autres cas, l’appel est formé, instruit et jugé selon les règles propres à la procédure sans représentation obligatoire.
