Article R611-47-1 of the French Commercial code

The proposals made by the mandataire ad hoc or the conciliator to the debtor on the terms of his remuneration shall be attached to the request mentioned in Article R. 611-18 or at the request mentioned in article R. 611-22. The proposals made by the conciliator are forwarded without delay by the court clerk to the public prosecutor.

The Chairman may only appoint an ad hoc representative or a conciliator whose appointment has not been proposed to him by the debtor after having obtained the debtor’s agreement on the terms of his remuneration.

In the absence of an opinion from the public prosecutor, the chairman may not open the conciliation procedure before the expiry of a period of forty-eight hours from the transmission provided for in the first paragraph.

Les propositions faites par le mandataire ad hoc ou le conciliateur au débiteur sur les conditions de sa rémunération sont jointes à la demande mentionnée à l’article R. 611-18 ou à la requête mentionnée à l’article R. 611-22. Les propositions faites par le conciliateur sont transmises sans délai par le greffier au ministère public.


Le président ne peut désigner un mandataire ad hoc ou un conciliateur dont la désignation ne lui a pas été proposée par le débiteur qu’après avoir obtenu l’accord de celui-ci sur les conditions de sa rémunération.


En l’absence d’avis du ministère public, le président ne peut ouvrir la procédure de conciliation avant l’expiration d’un délai de quarante-huit heures à compter de la transmission prévue au premier alinéa.
