Article R6111-60 of the French Public Health Code

The accommodation service referred to in this section may be provided by the establishment referred to in article R. 6111-55 or may be delegated to a third party under an agreement. The third party delegatee, who is chosen by this establishment, may be another healthcare establishment or any other public or private legal entity.

Accommodation may be provided within the establishment referred to in article R. 6111-55, in premises that are identified and separate from the care and hospitalisation areas. It may also be provided outside this establishment in premises dedicated to accommodation and located nearby. The premises must meet the requirements set out in article R. 164-1 of the French Construction and Housing Code.

If the service is delegated to a third party, an agreement is signed between the establishment mentioned in article R. 6111-55 of this code and the third party, specifying in particular the terms of access for the person accommodated and any accompanying person(s) mentioned in article R. 6111-59, their accommodation arrangements, the cleaning and hygiene conditions of the premises, the financial terms of the delegation, the safety rules and the respective responsibilities in the event of non-compliance with the reciprocal commitments made under the agreement.

La prestation d’hébergement mentionnée à la présente section peut être réalisée par l’établissement mentionné à l’article R. 6111-55 ou être confiée à un tiers par voie de convention. Le tiers délégataire, qui est choisi par cet établissement, peut être un autre établissement de santé ou toute autre personne morale de droit public ou privé.

La prestation d’hébergement peut être réalisée au sein de l’établissement mentionné à l’article R. 6111-55 dans des locaux identifiés et distincts des espaces de soins et d’hospitalisation. Elle peut également être réalisée en dehors de cet établissement dans des locaux dédiés à l’hébergement et situés à proximité. Les locaux doivent répondre aux obligations prévues à l’article R. 164-1 du code de la construction et de l’habitation.

Si la prestation est déléguée à un tiers, une convention est conclue entre l’établissement mentionné à l’article R. 6111-55 du présent code et le tiers, précisant notamment les modalités d’accès de la personne hébergée et de son ou ses éventuels accompagnants mentionnés à l’article R. 6111-59, leurs modalités d’hébergement, les conditions de nettoyage et d’hygiène des locaux, les conditions financières de la délégation, les règles de sécurité et les responsabilités respectives en cas de non-respect des engagements réciproques pris dans le cadre de la convention.
