If the culture ceases to be accessible either because it is no longer viable or because the authorised body is no longer able to supply samples, no account shall be taken of this interruption, provided that:
1° A new deposit of the micro-organism is made within a period of three months from the date on which the interruption was notified to the applicant or patent proprietor either by the authorised body or by the Institut national de la propriété industrielle ;
2° A copy of the filing receipt issued by the authorised body, together with an indication of the number of the patent application or patent, is communicated to the National Institute of Industrial Property within four months of the date of the new filing.
Where the interruption results from the non-viability of the crop, the new filing is made with the authorised body that received the initial filing; in other cases, it may be made with an authorised body.
The new deposit is accompanied by a written declaration by which the depositor certifies that the microorganism is the same as that which was the subject of the initial deposit.
The bodies authorised to receive deposits of microorganisms are designated by the Director General of the National Institute of Industrial Property.
