The request for authorisation to disclose and freely exploit the invention which is the subject of a patent application, before the end of the five-month period provided for in article L. 612-9, shall be filed with the Institut national de la propriété industrielle; it may be filed as soon as the patent application is filed. The authorisation is notified to the applicant by the Director of the Institut national de la propriété industrielle or, for European patent applications and for international applications for the protection of inventions, by the Minister responsible for industrial property.
In the absence of such authorisation and at any time, a request for specific authorisation to carry out specific acts of exploitation may be made directly by the patent applicant to the Minister of Defence. The latter, if he grants the authorisation requested, specifies the conditions to which these acts of exploitation are subject.
If the specific authorisation relates to the assignment of the patent application or the granting of a licence to exploit it, the Minister of Defence shall notify a copy of his decision to the Director of the National Institute of Industrial Property or, for European patent applications and for international applications for the protection of inventions, to the Minister responsible for industrial property.
