Article R612-36 of the French Intellectual Property Code

Until the fee for granting and printing the patent specification has been paid, the applicant may request the rectification of errors of expression or transcription as well as material errors found in the documents filed. The Institute may require justification of the reality of the material error to be corrected and, where appropriate, of the meaning of the correction requested.

If the request relates to the description, claims or drawings, the rectification shall only be authorised if it is obviously necessary, as no other text or layout could clearly have been considered by the applicant.

The request shall be made in writing and shall include the text of the proposed amendments; it shall be admissible only if it is accompanied by proof of payment of the fee due.

Jusqu’au paiement de la redevance de délivrance et d’impression du fascicule du brevet, le demandeur peut demander la rectification des fautes d’expression ou de transcription ainsi que des erreurs matérielles relevées dans les pièces déposées. L’institut peut exiger la justification de la réalité de l’erreur matérielle à corriger et, le cas échéant, du sens de la correction demandée.

Si la requête porte sur la description, les revendications ou les dessins, la rectification n’est autorisée que si elle s’impose à l’évidence, aucun autre texte ou tracé n’ayant pu manifestement être envisagé par le demandeur.

La requête est présentée par écrit et comporte le texte des modifications proposées ; elle n’est recevable que si elle est accompagnée de la justification du paiement de la redevance exigible.
