Article R612-4 of the French Intellectual Property Code

The patent application must not contain:

1° Elements or drawings the publication or implementation of which would be contrary to public policy or morality;

2° Denigrating statements concerning the products or processes of third parties or the merit or validity of patent applications or patents of third parties. Mere comparisons with the state of the art are not in themselves considered disparaging;

3° Elements manifestly extraneous to the description of the invention.

La demande de brevet ne doit pas contenir :

1° D’éléments ou de dessins dont la publication ou la mise en œuvre serait contraire à l’ordre public ou aux bonnes mœurs ;

2° De déclarations dénigrantes concernant des produits ou procédés de tiers ou le mérite ou la validité de demandes de brevet ou de brevets de tiers. De simples comparaisons avec l’état de la technique ne sont pas en elles-mêmes considérées comme dénigrantes ;

3° D’éléments manifestement étrangers à la description de l’invention.
