Article R612-41 of the French Monetary and Financial Code

A respondent who wishes to challenge a member of the Committee must, on pain of inadmissibility, make the request:

1° In the case of the rapporteur, within fifteen clear days of notification of the decision appointing the rapporteur;

2° In the case of a deliberating member, within eight clear days of notification of the composition of the panel called upon to deliberate;

3° If the reason given could not be made known to the respondent within the time limits provided for in 1° and 2°, at the latest before the end of the meeting provided for in Article R. 612-46.

Article R612-41

La personne mise en cause qui demande la récusation d’un membre de la commission doit, à peine d’irrecevabilité, en former la demande :

1° S’il s’agit du rapporteur, dans le délai de quinze jours francs à compter de la notification de la décision désignant celui-ci ;

2° S’il s’agit d’un membre délibérant, dans le délai de huit jours francs à compter de la notification de la composition de la formation appelée à délibérer ;

3° Dans le cas où le motif invoqué n’a pu être connu de la personne mise en cause dans les délais prévus aux 1° et 2°, au plus tard avant la fin de la séance prévue à l’article R. 612-46.
