Article R612-43 of the French Monetary and Financial Code

The Committee secretariat shall immediately notify the member concerned of the request for recusal and inform the Committee Chairman.

No later than the day before the meeting provided for in Article R. 612-46, the challenged member shall make known in writing either his agreement to the challenge or his reasons for opposing it.

If the challenged member agrees to the challenge, he shall be replaced by his alternate.

If this is not the case, the committee decides on the request. The person lodging the challenge is notified immediately by any means of the date of the meeting. He will be informed that he has the opportunity to present oral observations and to be assisted or represented by any counsel of his choice.

The committee shall decide without the participation of the member whose disqualification is requested. If he is not the member whose challenge is requested, the rapporteur takes part in the deliberations.

If the challenge is accepted, the member will be replaced by his alternate at the meeting provided for in Article R. 612-46. The committee’s decision specifies the new composition of the committee. This decision is immediately notified by any means to the person who made the request and to the member concerned.

Article R612-43

Le secrétariat de la commission communique immédiatement la demande de récusation au membre qui en fait l’objet et en informe le président de la commission.

Au plus tard l’avant-veille de la séance prévue à l’article R. 612-46, le membre récusé fait connaître par écrit soit son acquiescement à la récusation, soit les motifs pour lesquels il s’y oppose.

Si le membre récusé acquiesce à la demande de récusation, il est remplacé par son suppléant.

Dans le cas contraire, la commission se prononce sur la demande. L’auteur de la récusation est averti immédiatement et par tout moyen de la date de cette réunion. Il est informé de la possibilité qu’il aura de présenter des observations orales, et de se faire assister ou représenter par tout conseil de son choix.

La commission statue sans la participation de celui de ses membres dont la récusation est demandée. S’il n’est pas le membre dont la récusation est demandée, le rapporteur participe à la délibération.

Si la récusation est admise, le membre sera remplacé par son suppléant lors de la réunion prévue à l’article R. 612-46. La décision de la commission précise la nouvelle composition de la commission. Cette décision est notifiée immédiatement et par tout moyen à l’auteur de la demande et au membre intéressé.
