Article R612-46 of the French Intellectual Property Code

If, apart from the cases provided for in articles R. 612-8 and R. 612-45, the patent application is not formally in order with regard to the provisions of this title or the decree adopted for their application or has not given rise to payment of the prescribed fees, notification thereof shall be made to the applicant.

The notification will indicate the time limit set for the applicant to regularise his filing or pay the fees due. It may be accompanied by a proposal for regularisation. This proposal is deemed to have been accepted if the applicant does not contest it within the time limit set.

If the regularisation of the filing or the payment of the fees does not take place within the time limit, the patent application is rejected.

Si, en dehors des cas prévus aux articles R. 612-8 et R. 612-45, la demande de brevet n’est pas régulière en la forme au regard des dispositions du présent titre ou de l’arrêté pris pour leur application ou n’a pas donné lieu au paiement des redevances prescrites, notification en est faite au demandeur.

La notification indique le délai qui lui est imparti pour régulariser son dépôt ou payer les redevances exigibles. Elle peut être assortie d’une proposition de régularisation. Cette proposition est réputée acceptée si le demandeur ne la conteste pas dans le délai qui lui est imparti.

Si la régularisation du dépôt ou le paiement des redevances n’intervient pas dans le délai imparti, la demande de brevet est rejetée.
