Article R612-46 of the French Monetary and Financial Code

The Sanction Committee is convened by its Chairman. It may only deliberate if at least three members are present. If, pursuant to Article L. 612-10, a member other than the Chairman does not take part in the deliberations, he is replaced by his alternate.

If the Chairman is absent or unable to attend, the meeting is chaired by the second member of the Conseil d’Etat appointed pursuant to Article L. 612-9 and the Chairman’s alternate sits as a deliberating member.

If the Chairman and the second member of the Conseil d’Etat are unable to attend, the hearing is chaired by the Chairman’s alternate or, where applicable, by that of the second member of the Conseil d’Etat. If all the members of the Conseil d’Etat are unable to attend, the president or, where applicable, the second member of the Conseil d’Etat entrusts one of the other members with the task of chairing the hearing.

La commission des sanctions se réunit sur convocation de son président. Elle ne peut délibérer qu’en présence de trois membres au moins. Lorsque, en application de l’article L. 612-10, un membre autre que le président ne prend pas part à la délibération, il est remplacé par son suppléant.

En cas d’absence ou d’empêchement du président, la séance est présidée par le second membre du Conseil d’Etat titulaire nommé en application de l’article L. 612-9 et le suppléant du président siège en tant que membre délibérant.

En cas d’empêchement du président et du second membre du Conseil d’Etat, l’audience est présidée par le suppléant du président ou, le cas échéant, par celui du second membre du Conseil d’Etat. En cas d’empêchement de tous les membres du Conseil d’Etat, le président ou, le cas échéant, le second membre du Conseil d’Etat confie à l’un des autres membres le soin de présider la séance.
